Please read the following terms of use carefully.

These terms of use (hereinafter "Terms") apply to Maila & Suoja Oy's media channels, including the website at www.skymarxgolf.com, and other electronic services of Maila & Suoja Oy, such as Facebook and Instagram pages (hereinafter "Service" or "Services"), regardless of the device used to access the Services.

By using the Services, the user (hereinafter "User") agrees to comply with these Terms. The Services may also include channel- or activity-specific terms, which apply to the User's activities in addition to these Terms if the User uses such services or functions. If the User does not accept the Terms, the User should not use the Services. Additionally, if the user of the Service is a minor, they must ensure that their guardian consents to the use of this Service and is aware of the contents of these general terms of use, service-specific terms, and privacy policy.

If the Terms are deemed partially contrary to mandatory legislation, the nearest mandatory legislation shall apply to that extent, but otherwise the Terms shall remain valid.

The Services and the content produced therein (e.g., images, texts, graphics, and software) are the property of Maila & Suoja Oy and its partners (hereinafter together "Skymarx"), and may not be partially downloaded to a server or otherwise reproduced or copied, or distributed, transmitted, publicly displayed, or otherwise published in any form without the prior written consent of Maila & Suoja Oy. Notwithstanding the foregoing, the User may use the Services and their content for their own personal, non-commercial use, e.g., view and read the Services and the content, and print a copy or download a copy to their own device, provided that the User does not remove or modify any copyright, trademarks, or other rights notices. Modifying or using the Services and their content for any other purpose violates Skymarx's intellectual property rights. The Services and their content are provided to the User solely for lawful purposes. Skymarx grants the User a right to the Services or the content therein only as a limited, non-exclusive, transferable, and revocable right as stated above. The use of the Services and their content for commercial purposes is expressly prohibited. Ownership rights or intellectual property rights are not transferred to the User and remain with Skymarx and its contractual partners.

1. Personal Data

The User may provide personal data about themselves to Maila & Suoja Oy through the Services. Information may also be collected through cookies or similar technologies. Maila & Suoja Oy processes the personal data collected through the Services as the controller of the personal registers, acting in accordance with the applicable and applicable personal data legislation.

However, deleting or blocking the use of cookies may adversely affect the use of the Services or their features or even prevent it.

1. Location Data

The use of certain features, functions, benefits, or offers of certain Services may require the processing of location data. To use such functions or benefits and offers, the User must accept that Maila & Suoja Oy may process the User's location data to the extent required to provide and use the functions or benefits and offers. GoGolf Oy does not process location data for purposes other than those notified and for which the User has given their consent, after which the location data will be deleted. Location data is not disclosed to third parties.

The Services may contain downloadable material and links to external sites not controlled by Skymarx. Skymarx is not responsible for the content of such downloadable material or external sites. The User understands that Skymarx cannot guarantee or ensure the security of such downloadable material or external sites, such as that the files or software from any or any source available in the Services do not contain viruses, worms, Trojans, or other code or defects that are harmful or destructive. The inclusion of links in the Services does not imply that Skymarx in any way endorses the linked sites or shows any other connection between the owner or administrator of the linked site and Skymarx.

1. Entry into Force of the Terms and Changes

These Terms shall enter into force on May 1, 2023, and shall be in force indefinitely. Maila & Suoja Oy may change these Terms at its discretion at any time. The changes to the Terms will take effect when announced in the Services. The User is deemed to have accepted the amended terms if they continue to use the Services after the notification of the change.

The materials contained in the Services may contain technical inaccuracies or typographical errors. Maila & Suoja Oy has the right to change the Services or the materials they contain at any time. The Services and the materials they contain are provided "as is," and no express or implied warranties are given regarding them.

Skymarx is not responsible for any direct, indirect, direct or consequential damages, or special damages resulting from the use of the Services or the content therein, or the prevention of use, which may be due to, for example, but not limited to, non-performance, error, defect, interruption, fault, operation and transmission delay, computer virus, or line fault, regardless of whether the damages are based on contract, infringement, negligence, neglect, or other basis, and even if Skymarx or its representative has been advised of the possibility of such damages.

In addition, Skymarx is not responsible for any direct, indirect, direct or consequential damages, or special damages arising from the actions of the User on the golf course or in its vicinity.

In any case, Skymarx's liability is limited to the maximum liability under mandatory legislation.

1. Applicable Law and Dispute Resolution

These Terms and any agreement possibly made about the Service shall be governed by Finnish law. Any disputes shall be primarily resolved through negotiation between the parties. If this is unsuccessful, disputes shall be resolved in the first instance in the District Court of Helsinki. However, a consumer customer has the right to bring an action against Skymarx in the general lower court of their domicile. The consumer customer also has the right to request a resolution recommendation from the Consumer Complaints Board or Consumer Disputes Board for the dispute.
